Medicare Set Asides

A Medicare Set-Aside Allocation (MSA) is the only mechanism approved by the federal Centers for Medicare and Medicaid Services (CMS) for protecting the interests of all parties to a workers’compensation settlement.

Our professional staff is dedicated to providing the highest level of MSA services to our clients, including exceptional customer service, communication and follow-up. Turn-around time is two weeks from when we receive all necessary records and documents. Open and consistent communication on each MSA file is critical, and it is a part of what makes our service unique.

Legal Oversight:

Our MSA program is directed by our general counsel, who prior to his tenure with M Hayes, was national group counsel for workers’ compensation for a major property and casualty insurance carrier. He developed and managed the MSA program for this carrier. He lectures extensively on MSA’s and teaches in the MSCC certification course. He sits on the Medicare Reform Task Force in Washington, D.C., and is a principal drafter of the bill currently being introduced in Congress to overhaul the MSA statute as it relates to workers’ compensation.

Medical Expertise:

All Medicare Set-Aside Allocations are prepared by registered nurses who hold national certification as Nurse Life Care Planners or Certified Case Managers and also undergo the training to become a Medicare Set-Aside Consultant Certified (MSCC). Unlike non-medical allocators, our nurses have the expertise and credibility to assess(and question if necessary) the appropriateness of a treatment plan, including the prescription drug component. This is especially important with the addition of Part D prescription medicines. With expertise to determine when a claimant’s medical conditions justify a reduced life expectancy, our nurses also coordinate rated ages.

Coordination:

Our dedicated MSA staff provides consistent handling and tracking of your MSA, from initial referral through filing and approval with CMS. We value each referral and our specialized team ensures it receives the highest level of attention.
